Abstract
El presente ensayo analiza el tríptico conceptual "poder constituyente primario", piedra fundamental del derecho constitucional moderno, que resulta ser una figura más atractiva por sus potencialidades que por sus realidades ya que ha estado sujeta a fuertes variaciones o discontinuidades discursivas y pragmáticas relacionadas con su naturaleza, con su origen, su titular, sus funciones y sus límites. Los usos prácticos del concepto resultan más problemáticos y más ambiguos cuando se atribuye su titularidad al pueblo y cuando se analiza la efectividad de tal reconocimiento. En una primera parte se analizan el origen del concepto, sus implicaciones políticas y jurídicas, especialmente en relación con la posición de Kelsen, y en una segunda parte se presentan los usos del concepto en la historia constitucional colombiana y los obstáculos que han imposibilitado una efectiva aplicación de la titularidad del pueblo como constituyente primario. /
This essay analyzes the threefold concept primary constituent power, a milestone of modern constitutional law, whose attraction lies more in its potential rather than in its realities, due to its constant variations or speech and pragmatic discontinuity in its nature, origin, subjects, functions, and limits. The practical uses of this concept become more problematic and more ambiguous when its ownership is endorsed to the people, and when the effectiveness of such recognition is analyzed. In the first part of this essay, we analyze the origin of the concept, its political and legal implications, especially from Kelsen`s perspective. In the second part, we present the uses of the concept throughout Colombian constitutional history, and the o b s ta cl e s i n th e e f fe c t i ve implementation of ownership of people as primary constituent members.
