Abstract

When the states' political boundaries are considered, territorial borders of the states are that of which appears in minds in the context of international law rules. However the presence of the maritime boundaries between riparian states of a specific sea area is a reality of international law as well. In this line, the maritime boundary issue in the Aegean Sea, which hardly appears to be a subject of the disputes arose by the different reasons of the issues between two neighbour states Turkey and Greece, and seems as an uncertainty area that is discretion of the minds, is a factor directly affecting Turkish-Greek disputes. Therefore, the issue that Greece seeks to expand her sovereign rights that are transferred by the international treaties in the Aegean Sea and wishes to gain the sovereign rights of all maritime jurisdiction areas and islands outside 3 nautical miles of Anatolian peninsula has the ability to cause new disputes regarding her neighbour Turkey as well as contain some inner inconsistencies. In this respect, the aim of this paper is to analyze and reveal non-existence of any political boundary line that could give sovereign rights to Greece for maritime jurisdiction areas and islands that are not ceded by the international treaties, regarding territorial waters boundaries designated between Turkey, Italy and Greece by the international treaties in the Aegean, developing situations from past to present times and their impacts on Turkish-Greek issues.
