Abstract

The Roman juridical sources don't contain any definition about the legal costs and expenses. However, we can deduce a clear definition of both concepts through the terminological analysis. The costs are represented by the concepts impensae, expensae, impendia, dispendia and sportulae; the expenses by the concept sumptus. The legal costs could be defined as the payment established by the laws in a determined procedure, which is necessary to carry out it. The litigants have to pay these costs, but they can recovered them from those ordered to pay costs. [PUBLICATION ABSTRACT]
