Türk Hukukunda Telif Eserlerin korunması

Abstract

Bu tezin konusunu "Türk Hukukunda Telif Eserlerin Korunması" oluşturmaktadır. Bu kapsamda çalışmamızda 5846 sayılı Fikir ve Sanat Eserleri Kanunu'nda düzenlenen telif eser türleri, telif eserden kaynaklanan yetkiler ve bu yetkilerin ihlali halinde eserin korunmasına ilişkin hukuk davaları ele alınmıştır.

Çalışmanın birinci bölümünde telif hakkı kavramına ve düşünce özgürlüğü bakımından önemi sebebiyle korumanın tarihsel gelişimine değinilmiştir. Bunun yanı sıra eser kavramı, hukuken korunan telif eser türleri ve eser sahipliği kavramları incelenmiştir.

İkinci bölümde ise telif eserden kaynaklanan mali ve manevi yetkiler ile koruma süreleri ele alınmış; söz konusu yetkilerin ihlali halinde hukuka uygunluk sebepleri kanun koyucunun izlediği sistematiğe uygun şekilde incelenmiştir.

Üçüncü ve son bölümde ise telif eserden kaynaklanan yetkilerin ihlali halinde koruyucu hukuk davaları özellik ve usul hukuku yönünden ayrı başlıklar altında ele alınmış; söz konusu davalara ilişkin bilgiler güncel Yargıtay kararları ve uygulama örnekleri ile verilmiştir.

The subject of this dissertation is "Protection of Copyright Works in Turkish Law". In this context, within the framework of Law No. 5846 on Intellectual and Artistic Works, the types of copyright works, the authority arising from copyright works, and legal cases that are designated for the protection of copyright works are discussed.

In the first part of the study, the concept of copyright and historical development of protection due to its importance in terms of freedom of thought is mentioned. Also, the concept of the work, the types of legally protected copyrights, and the ownership of the work were examined.

In the second part, financial and moral authority and protection periods arising from copyright are discussed. The reasons for lawfulness in infringement of intellectual property rights were examined following the systematic followed by the legislator.

In the third and final part, lawsuits for the protection of copyright works are dealt with under separate headings in terms of substantial and procedural law. The information regarding the cases in question has been provided with the current Supreme Court and application precedents.
