Karşılaştırmalı Anayasa Hukuku açısından Türkiye ve Azerbaycan Cumhuriyetleri Temel hak ve Hürriyetler Sistemi

Abstract

Günümüzde bir ülkede yaşayan herkesin hak ve hürriyetlerini korumak, anayasal devletlerde demokrasinin en zaruri bir ölçütü olarak değerlendirilmektedir. Yazılı anayasalarda bir temel hak ve hürriyetler kataloğuna yer verilmesi, vazgeçilmez kriter olmuştur. Bu sebeple de, karşılaştırmalı anayasa hukuku bağlamında diğer devletlerin temel hak ve hürriyetler konusundaki anayasal tecrübelerinin öğrenilmesi, farklı ülkelerdeki mevcut anayasal problemler ve temel hak ve hürriyetlerle ilgili bu problemlerin çözüm yollarının incelenmesi oldukça önem arzetmektedir.

Tez üç bölümden oluşmaktadır. Birinci bölümde temel hak ve hürriyetler kavramı ile ilgili olan insan hakları kavramı, insan haklarının tarihsel gelişim sürecinde yaşananlar ve temel hak ve hürriyetlerin düşünsel temelleri gibi konular ele alınmıştır. İkinci bölümde Türk anayasacılığında temel hak ve hürriyetler konusu incelenmiştir. Üçüncü bölümde ise Azerbaycan anayasa hukukunda temel hak ve hürriyetlerin gelişimi, şuanki durumu, 1995 Azerbaycan Anayasası ve 1982 Türk Anayasası`na göre temel hak ve hürriyetler sisteminin karşılaştırılması yapılmıştır.

Preserving the rights and freedoms of everyone living in a country today is considered as the most indispensable measure of democracy in constitutional states. Inclusion of a fundamental rights and freedoms catalog in written constitutions has been an indispensable criterion. Therefore, in the context of comparative constitutional law, it is very important to learn the constitutional experiences of other states on fundamental rights and freedoms, the constitutional problems in different countries and the solution of these problems related to fundamental rights and freedoms.

The thesis consists of three parts. In the first chapter, the concept of human rights related to the concept of fundamental rights and freedoms, the historical development process of human rights and the intellectual foundations of fundamental rights and freedoms are discussed. In the second chapter, fundamental rights and freedoms in Turkish constitutionalism are examined. In the third chapter, the development of fundamental rights and freedoms in Azerbaijan constitutional law, its current status, the Constitution of Azerbaijan in 1995 and the fundamental rights and freedoms system in accordance with the 1982 Constitution of Turkey were compared.
